[Webinar] Digital Asset Dynamics and Case Studies: Insights from China, Singapore and International Initiatives

Overview

The digital and crypto asset market is said to have gone through all four seasons in a relatively short span of time. During the ebbs and flows, some jurisdictions have made new regulatory moves, many more national courts have had the opportunity to grapple with procedural and substantive issues concerning this asset class, and international organisations have also done significant work in this sphere. One example is the Digital Asset and Private Law project of the International Institute for the Unification of Private Law (UNIDROIT). 

This webinar, jointly organised by the Asian Business Law Institute and UNIDROIT, is expected to cover:

  • An overview of the UNIDROIT Principle on Digital Assets and Private Law, including key concepts such as proprietary rights and control;
  • Varying definitions of digital assets and concepts such as control and possession in different jurisdictions;
  • Property law treatment of digital assets in different jurisdictions, and the ensuing (proprietary) remedies available;
  • Creation of security interests over digital assets in different jurisdictions – for example, can security interests be created over such assets, and if so, how can those security interests be enforced?

China and Singapore will be among the key jurisdictions featuring in the discussions, with general references to other common law and civil law jurisdictions. Where relevant, court judgments will be mentioned, such as ByBit Fintech Ltd v Ho Kai Xin & Ors,  Cheong Jun Yoong. v. Three Arrows Capital Ltd, etc.

Speakers for this session are Professor Louise Gullifer KC (Hon) FBA (Rouse Ball Professor of English Law, University of Cambridge), Leow Jiamin (Partner, WongPartnership LLP) and Zeng Wenwen (Partner, Tian Yuan Law Firm).
