The Year In Review 2023

ABLI has had another prolific year in 2023.

With eight major releases that cover both established and emerging areas of the law, we continue to emphasize practical guidance and value-add in everything we do.

Readers who need to conduct an out-of-court workout across Asia but who may not have the experience doing so can look to the Principles and Practice Tips in the Guide on Conducting an Out-of-court Workout in Asia jointly published with the International Insolvency Institute. The Model Clauses for Contracting in Asia aims to help contract negotiators save time and cost by providing a common baseline and a set of (relatively speaking) balanced contractual terms that are neutral as to the governing law chosen and the subject matter of the contract. The Model Clauses are also supported by detailed commentaries on liquidated damages and penalty clauses and limitation of liability clauses, giving users the confidence that the Model Clauses are both actionable and credible. Although the hype surrounding cryptoassets has died down for the time being, ABLI has continued with the release of cryptoasset publications, benefitting readers who are taking advantage of this relatively quiet period to equip themselves with deeper understanding of this asset class.

Apart from our practical focus, we have also been more deliberate in emphasizing standard-setting. Both the Workout Guide and the Model Clauses enjoy a wide and diverse readership, with strong interest from turnaround professionals and in-house counsel. As they are on the frontline feeling and dealing with the negative effects of regional divergence of law, the strong take-up of our publications by these groups has been especially encouraging and gratifying.

On the events side, with generous support from speakers, we delivered pan-Asian content to over 300 attendees, discussing topics such as data protection, foreign investment, dispute resolution, cryptoassets regulation, contracting in Asia, and corporate restructuring. We also had various opportunities to present our work to a wide range of stakeholders, including policymakers who are shaping the future of Asian economic growth.
