Moving Towards Harmonisation in the Recognition and Enforcement of Foreign Judgments

The Project Lead for the Asian Business Law Institute’s Foreign Judgments project, Associate Professor Adeline Chong, foreshadows the results of our next product, Asian Principles for the Recognition and Enforcement of Foreign Judgments, in the Journal of Private International Law.

The Asian Principles for the Recognition and Enforcement of Foreign Judgments will summarise and compare the laws on the recognition and enforcement of foreign judgments in the ten members of the Association of Southeast Asian Nations, in addition to Australia, China, India, Japan and South Korea by analysing areas of commonality and divergence.

In her article, Professor Chong provides a summary of the Asian Principles for the Recognition and Enforcement of Foreign Judgments. Among other things, Professor Chong helpfully:

• articulates and clarifies the position under Thai law; and
• compares the laws of Asia against the Hague Judgments Convention.
