Jump-starting the conversation on recognition and enforcement of foreign judgments in Asia

ABLI’s Foreign Judgments Project and its first-phase output, Recognition and Enforcement of Foreign Judgments in Asia, are now cited in most journal articles or publications which address the issue of recognition and enforcement of foreign judgments in the region. We are delighted to see that our initiative appears to have successfully jump-started a conversation on this important area of the law in Asia.

Below are some of the most recent citations and references that have come to our attention:

In September 2019, the Singapore International Dispute Resolution Academy referred to ABLI’s Foreign Judgments project in its International Dispute Resolution Survey: Currents of Change – 2019 Preliminary Report.

On 19 September 2019, several authors of the Hon Justice Anselmo Reyes’ Recognition and Enforcement of Judgments in Civil and Commercial Matters cited chapters of ABLI’s Recognition and Enforcement of Foreign Judgments in Asia. ABLI is thanked by Justice Reyes in the Acknowledgements of the text.

On 30 September 2019, the High Court of Singapore handed down its decision in Merck KGaA and another v Merck Sharp & Dohme Corp and others [2019] SGHC 231 which cited ABLI’s Recognition and Enforcement of Foreign Judgments in Asia.

In October 2019, Man Yip, Associate Professor of Law from the Singapore Management University, referred to ABLI’s Foreign Judgments project in her piece titled The Singapore International Commercial Court: The Future of Litigation?, which was published in International Business Courts: A European and Global Perspective.

In October 2019, the Singapore report of ABLI’s Recognition and Enforcement of Foreign Judgments in Asia was cited in Harish Kumar and Jonathan Tarboton, “Singapore” in Louis Garb and Lew Julian (eds), Enforcement of Foreign Judgements (Kluwer Law International BV, Netherlands).

On 2 December 2019, the China report of ABLI’s Recognition and Enforcement of Foreign Judgments in Asia was cited in Zhiqiong June Wang and Jianfu Chen (eds), “Dispute Resolution in the People’s Republic of China The Evolving Institutions and Mechanisms” (December 2019, Brill).
