Restructuring Project mentioned in SAL’s Distinguished Speaker Lecture 2019

On April 1, 2019, ABLI’s joint project with the International Insolvency Institute, Asian Principles of Business Restructuring, was mentioned in the Honourable Justice Kannan Ramesh’s (Supreme Court of Singapore) Opening Address at the Singapore Academy of Law‘s Distinguished Speaker Lecture 2019.

This years’ lecture was titled “Re-imagining the Dispute Resolution Process in Cross-border Restructuring Practice” by the Honourable James Peck, former United States Bankruptcy Judge for the Southern District of New York. His Honour discussed, among other things, the value of mediation in restructurings both in domestic and cross-border matters.

Jim has contributed in other significant ways. From 2016 to 2017, he served as President of the International Insolvency Institute (or the “III”, as it is commonly known). The III is one of the leading global think tanks in insolvency, and has made significant contributions in many areas including UNCITRAL’s work on Model Laws. Jim’s presidency saw the III forge a new path in terms of projects, membership and geographical emphasis. One result of this has been a major collaboration between the III and the Asian Business Law Institute in the form of the Asian Principles of Business Restructuring project, which will produce a set of guiding principles for in-court and out-of-court restructuring for Asia.

 

His Honour’s lecture was followed by a panel, moderated by the Hon Justice Ramesh, featuring The Hon James Peck, Mr Patrick Ang, Ms Lisa Donahue and Mr Sushil Nair.

The lecture was held in the Supreme Court of Singapore on the sidelines of INSOL’s Annual Regional Conference 2019.

Both the Hon Justice Ramesh and Judge Peck are members of the Advisory Committee for ABLI’s Asian Principles of Business Restructuring project, and were part of the team that conceived of the project.
